Bennet is currently recognized as a City of the Second Class by the State of Nebraska and defined by Nebraska Revised Statute 17-311.
(1) Except as provided in section 17-312, whenever any village increases in population until it has a population of more than eight hundred inhabitants but less than five thousand inhabitants, as determined by the most recent federal decennial census or the most recent revised certified count by the United States Bureau of the Census, the village board of trustees shall certify such fact to the Secretary of State who, upon the filing of such a certificate, shall by proclamation declare such village to have become a city of the second class. After such proclamation, such city shall be governed by the laws of this state applicable to cities of the second class. The government of such city shall continue as organized at the date of such proclamation until the reorganization as a city of the second class.
The City of Bennet is governed by a City Council consisting of four (4) members. Any person who is a citizen of the United States, a resident of the municipality at the time of his or her election, and a registered voter may be eligible to be elected to the City Council for a term of 4 years. (Provided that a Council Member's term shall expire and the office will become vacant upon a change of residence from the municipality.)
The City Mayor is elected by the residents of Bennet during a general or special election vote.
The members of the City Council take an oath to support the Constitution of the United States, and the Constitution of the State of Nebraska, and faithfully and impartially discharge the duties of their office. All member elected to office meet at the first regular meeting of the Council in December, organize, and appoint the municipal officers required by law.
The City Council have the power and duty to maintain the peace, promote good government, and to prevent and remove nuisances and to enforce all ordinances.
